Ripple holders have filed a class-action lawsuit against Apple Inc, claiming that the company enabled a hacker attack that has caused heavy losses for many users. This happened after they downloaded an Apple application called “Toast Plus”.
According to AMBCrypto, it was Maryland resident Hadona Diep who took the matter to court. She claims that Apple’s negligence allowed such “phishing” applications disguised as crypto wallets to appear in App Store, inducing several Apple users to install a criminal portal into their crypto accounts.
The plaintiff is sure Apple is liable “directly and/or vicariously” for what has happened to Ripple users. It’s the company’s direct responsibility to check the software available on the App Store, especially when Apple receives about 30% of the commission fees, thus making billion-dollar profits. Users believe this is a good reason to prevent fraudulent applications from appearing on the platform.
This is not even the first lawsuit filed over Toast Plus. Despite the App Store being called the “safest and most trusted place for users to get apps”, Toast Plus users don’t think that’s the case. After seeing Toast Plus’s icon, many customers were led to believe it was a new version of Toast Wallet, a well-known cryptocurrency wallet app. The two can easily be mixed up since their names and icons are nearly identical. As a result, many Ripple users have lost their digital assets.
According to Hadona Diep, in 2018, she transferred 474 XRP to a crypto wallet she hasn’t used since. In March 2021, she downloaded the Toast Plus application, created a new wallet, but didn’t transfer her funds there. In August, the plaintiff discovered that her savings disappeared from the account, and the account itself was “deleted” almost immediately after registration. As a result, the loss she sustained amounted to more than $5,000. Deip claims that despite reaching out to Toast Plus and Apple support services, and law enforcement agencies, she didn’t manage to resolve the issue.
Judging by the application’s reviews, this seems to be a recurring problem. Hadona Deip encourages other victims to come forward and join her in court to demand compensation for material damage. Apple hasn’t yet commented on the situation.
