By registering for this program and using gift codes, you agree to comply with these GTCS as well as other applicable policies mentioned on our website. It is crucial to carefully read these conditions in order to understand your rights and obligations regarding the use of gift codes.

These GTCS constitute the legal framework for your participation in the loyalty program and specify in particular the purchasing, delivery, and return conditions for acquired products, thereby ensuring a clear and secure experience for all participants.

2. Purchase of Gift Codes

2.5 Procedure in Case of a Problem

If a user encounters an issue with a gift code, such as a non-functioning code or difficulties using it with a partner, the following procedure must be followed:

  • Contact Cointribune Support: Users must first contact our support team to report the issue. We commit to providing assistance to clarify the situation or direct the user to appropriate resources.
  • Contact the Partner Directly: If the issue relates to specific aspects of the product or service (such as code rejection or product/service defects), the user must contact the partner’s customer service directly.

3. Price and Payment

3.1 Acquisition of Loyalty Points

Loyalty points, called CT, are the currency of Cointribune’s loyalty program. These points cannot be purchased directly but are acquired through various activities on our platform, such as reading articles, participating in surveys or quizzes, and other interactions that may be introduced periodically.

3.2 Point Value

The value of loyalty points is determined exclusively by Cointribune and may be adjusted based on internal criteria, such as ongoing promotions or changes in loyalty strategy. Users will be informed of any significant change in point valuation through Cointribune’s usual communication channels.

3.3 Use of Points to Purchase Gift Codes

Accumulated loyalty points may be used to obtain gift codes that allow the purchase of products or services from our partners or on our platform. Each gift code will have a clearly indicated point value in the catalog accessible in the user area. The exchange of points for gift codes is irreversible once confirmed.

3.4 Payment Terms

No monetary payment is required to obtain loyalty points, which are issued free of charge in exchange for user engagement on our platform. However, for certain transactions or special offers involving partners outside the program, additional fees may apply according to specific terms established by those partners. These conditions will be clearly stated when presenting the offer.

3.5 Transaction Security

All point transactions and gift code exchanges are conducted in a secure environment. Cointribune commits to using state-of-the-art technologies to protect user data and transactions against unauthorized access and fraud.

3.6 Non-Refundability of Points

Given the nature of the loyalty program, once loyalty points are exchanged for gift codes, they are non-refundable. Cointribune does not offer refunds or compensation for spent loyalty points, except in cases where a specific product or service is no longer available due to an error attributable to Cointribune or its partners.

4. Delivery

Within our loyalty program, users may exchange their accumulated loyalty points for gift codes. These codes may then be used to obtain physical or virtual products from our partners. The following conditions apply to these exchanges:

4.1 Delivery Terms for Physical Products

Partner Responsibility

Delivery of physical products acquired via gift codes is entirely managed by our commercial partners. Cointribune does not intervene in product preparation, shipping, or delivery processes. All interactions after obtaining the code are carried out on our partners’ platforms.

Shipping Fees

Gift codes generally do not cover shipping fees unless otherwise stated by the partner. Users are responsible for verifying whether shipping fees apply when exchanging gift codes and must pay them directly to the partner.

Delivery Times

Delivery times may vary depending on the partner and the user’s geographic location. Estimated delivery times will be provided by partners at the time of gift code exchange and may also be available on product pages or during checkout.

Order Tracking

When available, a tracking number will be provided by the partner. Users may use this number to track delivery status on the partner’s website or via a direct link sent by email.

4.2 Delivery Terms for Virtual Products

Instant Delivery

Virtual products are often delivered instantly. Depending on the partner and product type, delivery may occur by email or be directly accessible through the user’s account on the partner’s platform.

Product Access

Detailed instructions for using or activating virtual products will be provided by our partners at delivery. These instructions may be included in the delivery email or available via a dedicated interface on our platform, depending on the partner’s chosen method.

4.3 Delivery Issues

Non-Receipt of Products

If a physical product is not received within the indicated timeframe, the user must contact the relevant partner’s customer service. If the issue persists, our customer support team may assist in facilitating communication with the partner.

Delivery Errors

If a product is delivered with errors (for example, incorrect or damaged product), the user must contact the partner’s customer service for resolution. The partner’s return and exchange policies will apply.

5. Right of Withdrawal and Return Policy

5.1 No Right of Withdrawal

In accordance with applicable regulations concerning the sale of digital services and digital content not supplied on a physical medium, Cointribune users do not benefit from a right of withdrawal for gift code purchases made on our platform. By accepting these general terms of sale when exchanging loyalty points for gift codes, you acknowledge and accept that:

  • Gift codes, once issued and received, are considered used, as they provide immediate access to partner products or services.
  • Transactions performed to obtain gift codes are final and cannot be canceled or refunded once loyalty points have been exchanged.

5.2 Return Policy

Since Cointribune only provides gift codes and does not directly manage physical products or final services, any issues regarding returns of products or services acquired via gift codes must be addressed directly to the relevant partners. Each partner has its own return policy, which must be reviewed before purchase.

Partner Responsibility

Our partners are responsible for managing returns according to their own terms and conditions. Cointribune does not intervene in transactions concluded directly between users and partners.

Return Instructions

To return a product or dispute a service received via a gift code, please contact the partner’s customer service directly. Contact details are provided with gift code information or available on partner websites.

5.3 Exceptions

If a gift code is technically invalid at the time of receipt, Cointribune will review each case individually to determine appropriate action. If the issue is our responsibility, appropriate measures will be taken to provide a replacement or, in exceptional cases, a refund of spent points.

Complaint Procedure

If you encounter an issue with a gift code, please contact our customer service within 48 hours of receiving the code. Provide a detailed description of the problem and, if possible, evidence of the error or defect.

6. Liability for Products

Within our loyalty program, Cointribune allows users to exchange accumulated points for gift codes. These codes may be used to acquire products or services from selected partners. Cointribune acts solely as an intermediary in distributing these codes and is not the final provider of products or services. The following outlines our liability regarding products obtained via gift codes:

6.1 Product Warranties

Product Origin

Products available via gift codes are supplied by external partners, not Cointribune. Consequently, Cointribune does not guarantee specific manufacturing or quality standards unless explicitly stated.

Product Compliance

Cointribune strives to partner with reliable and recognized suppliers. However, responsibility for product conformity with descriptions provided on our site or partner sites lies entirely with the partners.

6.2 Handling of Defects and Non-Conformities

Claims

If a product obtained via a gift code has a defect or does not match the provided description, the user must submit their claim directly to the partner supplier. Cointribune may help facilitate communication, but final resolution rests with the partner.

Support

Cointribune will provide guidance to users on how to proceed with claims but will not be directly involved in product return or replacement processes.

6.3 Limitations of Liability

Indirect Damages

Cointribune shall not be liable for indirect damages or consequential losses suffered by the user resulting from use of products obtained via gift codes, including but not limited to loss of revenue, profits, contracts, anticipated savings, data, or goodwill.

Force Majeure

Cointribune is not responsible for failures or delays in product delivery due to circumstances beyond reasonable control, including natural disasters, strikes, labor disputes, acts of war, epidemics, or government restrictions.

6.4 Warranty Procedures

Legal Warranties

All products acquired via gift codes benefit from applicable legal warranties under French law, including legal conformity warranty and warranty against hidden defects.

Exercising Warranties

To exercise a legal warranty, the user must contact the partner who supplied the product. Cointribune may provide procedural information but will not participate in the warranty process.

7. Amendments to the General Terms and Conditions of Sale

7.1 Right to Modify

Cointribune reserves the right to modify these GTCS at any time to reflect changes in operations, practices, applicable law, or to improve clarity and effectiveness. Modifications may concern gift code purchase terms, point exchange conditions, delivery practices, or return procedures.

7.2 Notification of Changes

Any change to the GTCS will take effect upon publication on our platform. Cointribune commits to informing users of any significant changes through reasonable means, such as email notification or prominent website announcement. Users are encouraged to regularly review the GTCS.

7.3 Acceptance of Changes

Continued use of the platform and loyalty program after GTCS changes take effect constitutes acceptance of the new conditions. If you do not accept the new terms, you may stop using the services and close your Cointribune account.

7.4 Impact of Changes

Changes to the GTCS do not affect transactions completed before their effective date, unless required for legal or security reasons. In such cases, Cointribune will endeavor to provide reasonable notice.

7.5 Your Responsibilities

It is your responsibility to review current GTCS whenever you conduct transactions on our platform. For questions or concerns, contact customer service for clarification.

8. Governing Law and Dispute Resolution

8.1 Governing Law

These GTCS are governed by and interpreted in accordance with French law.

8.2 Competent Jurisdiction

In case of dispute regarding interpretation, execution, or validity of these GTCS, parties shall seek an amicable solution. Failing that, disputes will be submitted to the competent courts of Paris.

8.3 Mediation

Before legal action, parties agree to attempt mediation. An independent mediator will be chosen by mutual agreement or designated by the President of the Paris Judicial Court. Mediation will be confidential, and costs will be shared equally unless otherwise agreed.

8.4 Online Dispute Resolution

EU consumers may submit complaints via the European Commission’s Online Dispute Resolution (ODR) platform.

8.5 Non-Waiver Clause

Failure by either party to enforce any provision of these GTCS shall not constitute a waiver of that provision.
