Binance And MiCA Clash Over Continued EU Registrations

The Sandmark investigation and the validation of registrations on Binance

While the MiCA regulation has been in effect since July 1st, the conclusive findings published by the crypto analysis platform Sandmark revealed this case. On August 19, experts from this firm conducted live registration tests from various European Union member countries such as Germany, Austria, Belgium, Spain, and France. They used standard connections as well as virtual private networks (VPNs). Thus, this experiment allowed them to observe that the exchange was still accepting new clients from Europe without imposing strict geographic blocking or issuing any alert about its regulatory status.

The exchange platform fully validated two accounts subject to complete identification procedures (KYC). This validation therefore unlocks full access to all financial operations, primarily to receiving crypto deposits. Such discoveries come at a time when the exchange had previously withdrawn its MiCA authorization request with the Greek authorities, content to send notifications to its users to reassure them about the safety of their money and the possibility to make withdrawals.

This scenario surprised many observers. Indeed, they expected on an operational and technical level a strict territorial blocking of the Binance platform’s infrastructure. Without a clear warning message on the lack of MiCA license during account opening, the exchange allows European users to start business relationships freely.

The testers noticed a simplified registration process. This procedure demonstrates that no automated filter prevents the arrival of euro zone citizens. The service continuity is total given the permanent access to various deposit mechanisms on these new confirmed accounts. This situation thus contradicts the withdrawal dynamic that the exchange was supposed to carry out after its adjustments related to regional regulation.

The major findings from this investigation are summarized as follows :

  • Full territorial accessibility : effective account validation from five European Union countries ;
  • A KYC process without restriction : complete absence of any warning message regarding the lack of MiCA authorization during the registration procedure ;
  • Immediately operational financial services : maintenance of all key functionalities, including direct crypto deposits on the new validated accounts.

The requirement for orderly withdrawal and the exchange’s position

The stance of the European Securities and Markets Authority (ESMA) is very firm regarding these practices. Therefore, the EU regulator has published unambiguous guidelines. These recommendations instruct unauthorized companies to take immediate measures to orderly terminate their various services within the EU, while safeguarding clients’ interests and providing guarantees against risks to market integrity.

Such strict instructions would imply the interruption of registrations of European clients, the creation of new accounts, as well as any marketing campaigns starting from July 1st. Regarding these alleged breaches, the Binance platform claims that it still intends to continue its activities in Europe. That is why it continues efforts to comply with European standards. The exchange stated: “following the implementation of MiCA, we have taken steps to ensure that the availability of our products and services in Europe aligns with applicable legal and regulatory frameworks”.

This institutional reaction demonstrates the desire to maintain a strategic presence in this high-potential market of several hundred million solvent consumers. By alleging internal invisible adjustments to comply with the texts, the company tries to preserve its image as an important and legitimate player playing with ESMA’s implementation timeline. This gap between official statements based on long-term compliance and the reality concerning registrations raises questions about the maneuvering room the crypto firm still holds against the coercive power of the EU regulator.

The onset of financial sanctions and escalation prospects

This strict position of European regulation is already concretely manifested on the ground through direct financial penalties affecting other players. Thus, on August 14, the Austrian Financial Market Authority (FMA) imposed a fine of 70,000 euros on the Bitpanda exchange for violations related to notification and marketing obligations under MiCA.

This case shows that national financial regulators crack down as soon as they notice breaches of various solicitation or information standards. In this perspective of total inflexibility, the operational privileges granted put non-compliant exchanges in a precarious legal situation with regards to national jurisdictions.

The continuous access of clients located in Europe to unauthorized service offerings signals a progressive and inevitable tightening of controls in the coming weeks. If sector giants like Binance continue to maintain their user flows without a MiCA license, the supervisory authorities would quickly impose financial fines and radical sanctions such as targeted blocking of IP addresses or disconnection from fiat banking rails. For crypto investors, this legal void significantly increases liquidity and access risks to their tokens.
