Austria: Bitpanda Receives the First Public Fine Related to MiCA
The European cryptocurrency framework enters a new phase with an official sanction. Bitpanda is fined 70,000 euros in Austria for several breaches of MiCA rules. The FMA notably reproaches the platform for errors in the transmission and communication of certain documents. This legally final decision marks an important step in the concrete application of the new European regulation. Bitpanda at the heart of the first MiCA sanction
The Austrian Financial Market Authority, the FMA, imposed a fine of 70,000 euros on Bitpanda. The crypto exchange, based in Vienna, had not submitted the required white paper by the deadline. The document had to reach the FMA at least 20 working days before its publication. This obligation is part of the procedural rules provided by MiCA to regulate communications related to crypto-assets.
The FMA also noted several issues in Bitpanda’s marketing communications. Before the corresponding whitepaper was published, an initial communication took place. However, MiCA prohibits this practice to ensure coherent information before any promotion. In another message, Bitpanda did not include certain mandatory legal mentions related to the document’s status.
The message had to specify that the whitepaper had not been reviewed or approved by a regulatory body. It also had to remind that its issuer remained responsible for its content. Bitpanda had also omitted a required phone number and email address. These breaches thus concern procedure and transparency, without accusations of fraud or mention of losses for investors.
A final and mainly procedural decision
The case was handled according to an expedited procedure under Austrian financial market law. The FMA specifies that the decision regarding the sanction now has a legally final character. This outcome thus closes the procedure initiated around the various breaches noted.
The sanction does not concern fraud or losses suffered by investors. This distinction remains important for understanding the scope of the decision targeting Bitpanda. The platform faces a regulatory measure related to its practices.
The case mainly illustrates how authorities apply the new framework to companies. The regulation seeks to create a common framework in the 27 Member States of the European Union. It notably pursues objectives of investor protection and crypto market integrity. Documentary requirements and public communications thus hold an important place.
Bitpanda facing the gradual rollout of MiCA
This sanction occurs as Bitpanda operates in a period of adaptation to the new European framework. The regulation fully came into force for crypto service providers at the end of 2024. A transition period allowed existing companies to continue activities during their authorization process.
Companies that do not fully comply with the new requirements thus risk increased regulatory pressure. The platform itself holds a MiCA license and continues its expansion in Europe. However, its case shows that holding a license does not exempt one from fulfilling all obligations. The rules also regulate documents, deadlines, and the messages addressed to the public.
The European framework could still evolve, as Brussels plans a review in 2027. Proposals could then strengthen supervision of foreign stablecoin issuers. The sanction thus provides a first public example of control of European requirements.
As the MiCA regulatory framework unfolds, platforms will need to maintain constant attention to their documentary obligations and communications. The Austrian case shows that procedural rules already play a concrete role in supervising the European crypto market.
